TERMS AND CONDITIONS OF SALE OF Castello di Perno
1. Ownership of the Website
These general contract conditions (hereinafter also “General Conditions”) regulate the offering of products by Castello di Perno soc. agr. sempl., a company with its registered office in Monforte d’Alba (CN), Località Castelletto 33 (VAT number 03509700047) (hereinafter also “Castello di Perno”), on its website www.castellodiperno.it (hereinafter also “Website”).
Photos, texts, descriptions, and everything stated on the website are consequently the property of Castello di Perno.
Reproduction of any part of the website, whether in full or in part, is prohibited. Reproduction of texts or photos for any purpose and in any form is also prohibited without the prior written authorization of Castello di Perno.
2. Background and Acceptance of the General Conditions of Sale
The General Conditions must be accepted by the user upon registering on the Website to be able to use the offered service.
Castello di Perno reserves the right to modify these conditions, in whole or in part, at any time by notifying the user of such changes by publishing them on the Website.
The user who continues to use the Website after the publication of the modifications accepts the new conditions without reservation.
3. Website Registration
The Website is exclusively intended for users who have reached the age of 18.
Navigation and use of the services offered on the Website are accessible after a registration procedure.
Registration is free. The user must register by providing all the requested information truthfully and completely in the registration form and must fully accept the privacy policy and these General Conditions. The user agrees not to share their credentials, even temporarily, with third parties and to keep them under their responsibility, as they are the only means to identify the user and validate their access to the offers. Therefore, the user is informed that all acts performed using these credentials will be attributed to them and will be legally binding on them.
It is understood that under no circumstances can Castello di Perno be held responsible for the loss, dissemination, theft, or unauthorized use by third parties, for any reason, of user access credentials.
Registration is necessary to proceed with the purchase of products and to access the summary information about the user’s activities on the Website (also “Account”).
Partial registration on the Website is also allowed, by entering only the user’s email address for receiving newsletters. In the event that a user who has made a partial registration wishes to proceed with the purchase of products on the Website, it will be necessary to complete the mandatory fields before the checkout phase for the purchase to be completed.
At any time, the user may update and/or modify or request the deletion of information provided during registration. In case of a deletion request, however, Castello di Perno may temporarily keep all or part of this information for the sole purpose of executing any purchases made and/or completing accounting and tax procedures.
Castello di Perno reserves the right to suspend or delete the user’s Account at any time and without notice if it believes that: i) the user has violated the contract, ii) access or use of the service could cause damage to Castello di Perno, other users, or third parties, iii) the user’s use of the Website may result in a violation of applicable laws or regulations in case of investigations conducted following legal actions or involvement of public authorities, iv) the Account is deemed by Castello di Perno, at its sole discretion and for any reason, inappropriate or offensive, in violation of the contract, or not in line with Castello di Perno‘s standards.
4. Identification of Products
The images and descriptions on the Website reproduce the characteristics of the products as faithfully as possible. These images should be understood as indicative; for the purposes of the purchase contract, the product description contained in the order form submitted by the user will prevail. The photos serve the sole purpose of representing the product and may differ from the original in small details, such as the indication of the year or graphic updates due to legislative changes. The images of the products are purely illustrative and do not constitute a contractual element.
These general conditions of sale do not govern the sale of products and/or the provision of services by entities other than Castello di Perno that are present on the Website through links, banners, or other hyperlinks.
The products offered for sale on the Website are only those advertised in the “Shop” section. The catalog may include product availability subject to quantity and/or time limits.
5. Offer Conditions
Before completing the purchase, the user must review the characteristics of the goods as described in the product page they intend to purchase.
The prices published on the Website are in Euros, always include VAT, and may be subject to periodic changes without prior notice. Shipping costs, if applicable, are to be added to the product price. The price of the goods sold is the one summarized in the order form at the end of the purchase.
Prices and stock availability may change without notice.
The sale of alcoholic products is prohibited for minors. Users of the Website declare that they are of legal age according to their applicable legislation.
Castello di Perno will not be responsible for failure to meet contractual obligations due to unforeseeable circumstances beyond its reasonable control.
The effectiveness of offers will be subject to quantity or time limitations. The duration of offers and/or the available quantity of the products subject to them will be published on the Website to allow the user to be informed. Castello di Perno may change the duration of an offer at any time at its discretion, provided it fulfills orders placed during the validity of a particular offer.
6. Coupons
Castello di Perno can issue discount codes (hereinafter “Coupons”) that the user can use when purchasing products. Coupons are issued in the form of alphanumeric codes, and their function is determined unilaterally and at the total discretion of Castello di Perno.
The user can enter the Coupon in the designated “Coupon” field when placing an order. Coupons are generally available to the user for a limited time, after which they cannot be used. The Coupon may be subject to a minimum spending amount below which it cannot be used. Unless otherwise specified, the Coupon is personal and linked to the user’s Account and can be used for a single purchase, after which it will be automatically invalidated. Coupons cannot be combined. Coupons cannot be sold, transferred, or assigned to third parties without the express authorization of Castello di Perno.
Castello di Perno reserves the right to cancel any Coupon previously issued, even before its expiration, without the obligation to justify the reason and without the right to compensation or reimbursement. Castello di Perno reserves the right to delete Coupons issued to users who misuse them, without prior notice and without the right to compensation or reimbursement.
7. Purchase Procedure and Payment Methods
Each order submitted constitutes an offer to purchase the products in the order. The processing of orders is subject to the availability of the ordered products and their discretionary acceptance by Castello di Perno.
The user must select the products and complete the checkout after carefully verifying the information contained in the order summary. The order is placed by confirming it and is subject to the payment of the price, taxes, shipping, and payment fees indicated.
Following successful payment, the user will receive an order confirmation email containing information about the purchased offer. The order confirmation will include a summary of the delivery and billing address. In the absence of the confirmation email, the purchase cannot be validly considered concluded.
The payment for the order can be made during checkout through [credit card, PayPal, Satispay]. In the case of Satispay, the merchandise will be shipped only after the actual payment is credited.
The confidential credit card details, card number, cardholder, expiration date, and security code, are encrypted and transmitted directly to the payment processor without passing through the server used by Castello di Perno. Therefore, Castello di Perno does not have access to, and does not store the payment information used by the user for product purchases, except for the name of the cardholder of the payment instrument.
By placing an order on the Website, the user consents to receiving the invoice in electronic format. The issuance of the invoice will be based on the information provided by the user, which the user declares and guarantees to be accurate. The user undertakes to hold Castello di Perno harmless from any damage, including sanctions imposed by the competent authorities, that may result from inaccurate information.
The amounts due will be charged, unless otherwise specified in the terms of the offer, upon payment confirmation. In any case, Castello di Perno uses third-party tools for payment processing and does not have any contact with the payment data provided, such as those related to various payment instruments used. In case of non-confirmation of the order for any reason, Castello di Perno will fully refund the amount paid by the user.
8. Shipping, Delivery, and After-Sales Support
It is not possible to guarantee a specific date or time of delivery as this depends on the courier, the delivery address, and the delivery agent. Therefore, Castello di Perno cannot be held responsible for any direct or indirect consequences arising from these timing issues. Castello di Perno cannot be held responsible for delivery errors due to inaccuracies or omissions in the user’s purchase order, damages that may occur to the products after delivery to the carrier, or delays in delivery that are attributable to the carrier.
It is the user’s responsibility to check the condition of the product upon receipt and upon pickup. While the risk of loss or damage to the products, not attributable to Castello di Perno, is transferred to the user when they physically take possession of the product, it is recommended that the user verify the number of products received and that the packaging is intact, undamaged, not wet, or otherwise altered, including the sealing materials. For the user’s interest, any anomalies should be noted on the carrier’s transport document, and the package should be accepted with reservations. The unconditional receipt of the products does not allow the user to take legal action against the carrier or Castello di Perno.
Any problems related to the physical integrity, correspondence, or completeness of the products received should be reported within 3 days of delivery by sending an email to: info@castellodiperno.it/ sales@castellodiperno.it. In the communication, the user must provide a description of the identified defect, indicate the product code, as well as the order number issued at the time of purchase and the identifying details of the invoice issued by the seller regarding the purchased products.
In the event of non-delivery of the goods within the specified timeframes, the user will be required to notify Castello di Perno, which will verify the shipment status with the carrier and any anomalies.
The order will be delivered only to individuals who can prove they are of legal age, excluding delivery to post office boxes.
Once the order form is registered, the customer will receive the order confirmation via the email address provided during registration on the Website. The order confirmation will also contain the order number, which should be used in any subsequent communication with Castello di Perno.
The customer is responsible for the accuracy and completeness of the information provided and is required to provide any information that may facilitate delivery.
In the event that the delivery agent cannot find anyone at the declared address, the merchandise will be returned to the seller’s location. This will result in additional costs that will be charged to the buyer.
9. Right of Withdrawal
In the case of purchasing products on the Website, the buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receiving the products, by returning the delivered goods intact and without any alterations to Castello di Perno. The right of withdrawal does not apply to sealed products that have been opened by the customer.
The withdrawal notice must be sent by email to the address info@castellodiperno.it / sales@castellodiperno.it within 14 days from the delivery date and must include:
a) The user’s expression of the right of withdrawal under and for the effects of art. 54 of Legislative Decree no. 21/2014;
b) The indication of the products for which the customer intends to exercise the right of withdrawal, including the specification of the product’s article code;
c) The order’s sequential number issued at the time of purchase;
d) The identifying details of the electronic invoice issued by the seller for the purchased products.
The buyer who has exercised the right of withdrawal must return the goods intact and without any alterations within 14 days from the date of the withdrawal notice. The return shipping costs are the responsibility of the user. The goods must be sent to Castello di Perno, Monforte d’Alba (12065 CN), Locality Castelletto 33. The user is responsible for the packaging of the goods they intend to return and is therefore committed to taking the necessary precautions to preserve the product’s integrity and protect it from damage and alterations.
The goods must be returned intact, in their original packaging, complete in every part, and accompanied by the attached fiscal documentation. Subject to the right to verify the above, Castello di Perno will proceed to credit the amount paid for the purchase of the product/products to the withdrawing party within a maximum of thirty days from the date on which the seller becomes aware of the exercised right of withdrawal.
In any case, the credited amount will not be issued before:
a) Castello di Perno has received the shipment of the product/products;
b) Castello di Perno has verified the integrity of the product/products.
The clauses related to the exercise of the right of withdrawal, as well as the related consequences and exceptions, apply exclusively to users who can be classified as consumers, i.e., users who act for purposes unrelated to their business and professional activities.
10. Castello di Perno’s Responsibility
Castello di Perno will not be liable for damages that may arise from the use of the Website, such as computer viruses, omissions, service interruptions, and software malfunctions, including harm to the user’s computer equipment, which prevents or delays service provision, if these are due to external causes, force majeure, and/or third parties not dependent on the owner’s will.
In any case, Castello di Perno cannot, in any event, be held liable for delays or defects caused by events beyond their reasonable control, such as, for example: (i) force majeure events; (ii) events due to third-party actions, such as the interruption or malfunctioning of telecommunications operators’ services and/or power lines, or acts or omissions by carriers or shippers.
11. Intellectual and Industrial Property
Castello di Perno holds all rights related to the graphic and conceptual content of the Website, their distinctive visible marks, as well as any names, symbols, and images used to identify products on the Website. Therefore, the reproduction, even in part, of the content and graphics of the Website, as well as the visible distinctive marks, is prohibited.
12. Privacy
Personal data is collected and processed to respond to user requests. Castello di Perno guarantees its users that it operates in compliance with the regulations on personal data processing, governed by the Privacy Code pursuant to Legislative Decree no. 196/2003. The data controller is Castello di Perno.
Any complaints must, therefore, be addressed to: Castello di Perno.
Upon registration, the user may be asked to consent to receiving commercial information, including through the sending of newsletters. In this case, the user is free to give or withhold consent.
13. Cookies
For the proper functioning of the Website, the use of Cookies is necessary. Cookies are used to obtain information about terminals, operating systems, IP addresses, and the type of browser in use to offer the user a better browsing experience. These are generally statistical data that do not contain sensitive information. It is possible to deny the use of Cookies by activating the option to disable them on the browser or device in use.
14. Applicable Law and Jurisdiction
These General Terms of Sale are governed by Italian law and interpreted in accordance with it. Therefore, the interpretation, execution, and resolution of the general terms of sale are subject exclusively to Italian law. Any dispute relating to the general terms or sales contracts will be under the jurisdiction of the court of Asti. For any disputes concerning the interpretation, execution, and/or resolution of the contract between the user and Castello di Perno, the parties recognize that the judge of the user’s place of residence or domicile is competent, provided that the user is considered a “consumer” under current consumer protection laws.
